Terms of use
Last updated: 14 October 2026
These terms apply to Ava Smart Care on the website and in the phone app. The service is provided by [Controller name], [postal address]. The privacy policy explains how we handle personal data.
What the service does
Ava Smart Care helps the people around an older person organise support together: messages, tasks, visits, observations, assessments, reports and plans. It doesn't give medical advice and doesn't replace a doctor, Spitex or emergency services. In an emergency, call 144.
Assessment results, suggestions and texts written by the assistant help an advisor and the family plan. They can be incomplete or wrong. Check them before you rely on them. Decisions about care are made by people.
Your account
You need to be 18 or older to create an account. Give your real name and an email address you use, keep your password to yourself, and use the account only yourself. Tell us at [privacy email] if you think someone else has used it.
Information about other people
A care group holds information about the person being helped and about the people who help. Add information about someone else only when you're allowed to: they have agreed, or you're entitled to act for them. Choose the audience of a conversation or observation with care, because its members see it.
Your content
What you add stays yours. You allow us to store it, to show it to the people you share it with, and to process it as described in the privacy policy, for as long as it is kept there.
Using the service fairly
Don't use Ava Smart Care to break the law, to harass anyone, or to share content you have no right to share. Don't try to reach data you haven't been given access to, to disrupt the service, or to copy it with automated tools.
Professionals and organisations
Advisors, providers and their staff stay responsible for their professional duties, their own records and their agreements with the people they help. An organisation that uses Ava Smart Care may have a separate contract with us, which takes precedence over these terms where the two differ.
Fees
Any fees are agreed separately before they apply.
Availability
We work to keep the service available and your data safe. Maintenance or faults can interrupt it. We tell you in advance when we can.
Liability
We are liable for damage we cause intentionally or through gross negligence. As far as the law allows, we are not liable for slight negligence, for interruptions, or for decisions taken on the basis of content in the service.
Ending
You can delete your account at any time. We may suspend or close an account that breaks these terms, and we tell the account holder why.
Changes
When we change these terms in a way that affects you, we tell you in the app before the change applies. If you don't agree, you can delete your account.
Law and courts
Swiss law applies. Courts at [seat of the controller] have jurisdiction, unless the law gives you the right to go to court where you live.
